1. About these Terms

This website is operated by GGN Trading Pty Ltd under the Big Bee Workwear brand ("Big Bee", "we", "us" or "our"). These Terms of Service apply when you access https://bigbee.com.au, purchase products from us, or otherwise use our online store.

By using the website or placing an order, you agree to these Terms together with the policies referred to in them.

Nothing in these Terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded, including rights under the Australian Consumer Law and any other mandatory rights that apply to a customer under applicable law.

2. Australian seller and contract formation

Big Bee is an Australian business operated from New South Wales, Australia.

Unless expressly agreed otherwise in writing, orders placed through our online store are accepted by GGN Trading Pty Ltd in New South Wales, Australia. To the maximum extent permitted by applicable law, the contract for the sale of goods is formed in New South Wales when we accept the order.

Orders are processed and fulfilled by or on behalf of Big Bee from Australia unless we expressly state otherwise.

3. Website and customer information

You must provide information that is accurate and reasonably complete when placing an order or contacting us. You are responsible for keeping account login details secure if you create a customer account.

You must not misuse the website, attempt unauthorised access, interfere with website security, introduce malicious code, scrape or copy the website in a way that infringes our rights, or use the website for unlawful purposes.

4. Product information

We aim to present product descriptions, specifications, images, sizing and prices accurately. Minor colour differences can occur because of screen settings, photography and normal production variation. This does not limit your rights if a product is materially different from its description or otherwise fails to meet a mandatory consumer guarantee.

Fabric, fit, pocket layout, reflective tape, hi-vis features, UPF ratings and other specifications vary by product. Please check the individual product page before ordering.

Where Big Bee expressly states that a particular product complies with an identified Australian standard, rating or requirement, that statement applies only to the product and configuration described.

5. International customers and local requirements

Big Bee sells from Australia to selected international destinations.

Unless Big Bee expressly states otherwise in writing for a specific product and destination, our product descriptions, workwear terminology, hi-vis references, reflective tape references, safety information, UPF information, sizing, labelling and compliance statements are prepared primarily for the Australian market.

Big Bee does not represent or warrant that a product complies with any foreign workplace rule, PPE rule, hi-visibility requirement, technical standard, certification requirement, labelling rule, import rule or other local regulation outside Australia unless that compliance is expressly stated by Big Bee for that product and destination.

International customers are responsible for checking before purchase whether a product is suitable and lawful for importation, possession, resale and intended use in their destination country and workplace.

Nothing in this section limits any mandatory consumer right that cannot lawfully be excluded, or any obligation arising from an express representation made by Big Bee about a product.

6. Orders, availability and acceptance

After you place an order, you will normally receive an electronic confirmation. We may contact you if there is an issue with stock availability, pricing, payment, delivery information or another material part of the order.

We may refuse or cancel an order where reasonably necessary, including for suspected fraud, payment problems, obvious pricing or system errors, unlawful activity, or where an item is unavailable. If we cancel an order after payment has been taken, we will refund the affected amount.

If we cannot supply an item, we may offer an alternative where appropriate or cancel the affected item and refund any amount paid for it.

7. Prices, currency, tax and payment

Unless clearly stated otherwise, prices displayed for the Australian market are in Australian dollars (AUD) and include GST where GST is applicable.

Prices, currencies, taxes and duties displayed for international customers may vary according to market, destination, Shopify settings and checkout configuration.

Available payment methods are shown at checkout. Payment processing may be provided by Shopify and/or third-party payment providers and may be subject to their own terms and privacy practices.

8. Shipping and delivery

Big Bee offers free standard shipping Australia-wide on all orders, with no minimum order value.

International shipping is available only to destinations offered at checkout. Delivery estimates are not guaranteed delivery dates and may be affected by carriers, customs, weather, public holidays and other events outside our reasonable control.

9. International customs, duties and import charges

International orders may be subject to customs clearance, import duties, taxes, brokerage charges or other local fees.

Unless expressly stated otherwise at checkout, these charges are imposed by the destination country or service provider and are the customer's responsibility.

The customer is responsible for complying with import restrictions and other destination-country requirements that apply to the goods ordered.

10. Returns, refunds and consumer rights

We offer a voluntary change-of-mind policy subject to the eligibility requirements in that policy. This voluntary policy is separate from rights under the Australian Consumer Law and any other mandatory rights that cannot lawfully be excluded.

11. Bulk orders and custom logo work

Bulk, team and custom-decorated orders may be subject to product availability, minimum quantities, artwork requirements, decoration suitability, separate production lead times and pricing confirmed in a quote or order confirmation.

If you provide a logo, artwork, name, design or other material for reproduction, you confirm that you own it or have permission to use and reproduce it for the order. You grant us a limited permission to use that material only as reasonably necessary to quote, prepare artwork, produce and fulfil your order, retain production records and handle related customer service.

We may refuse artwork or instructions that we reasonably believe are unlawful, infringe third-party rights, or cannot safely or appropriately be applied to the selected garment.

For hi-vis or reflective garments, decoration placement must not interfere with required visibility or safety features. We may advise on a suitable position, but the purchaser remains responsible for checking that the final garment is suitable for the requirements of the intended workplace or task.

Custom-decorated items are not eligible for change-of-mind returns once decoration has been produced. Mandatory consumer rights remain unaffected.

If a written quote, artwork approval or order confirmation contains specific terms for a bulk or custom order, those specific terms apply to that order to the extent of any inconsistency with these general Terms, subject always to applicable law.

12. Shopify, privacy and enhanced services

Our store is hosted by Shopify. When you visit or purchase from our store, Shopify processes personal information in connection with operating the store and providing Shopify services.

Shopify Network Intelligence is enabled for our store. Shopify may process information from interactions with our store together with information from interactions with other Shopify merchants and with Shopify to provide services such as fraud prevention, analytics, personalisation, advertising and other enhanced services.

Information may be shared with Shopify and other third parties or service providers that may be located in countries outside Australia in order to provide these services.

13. Promotions and discount codes

Promotions, discount codes and special offers may be subject to stated conditions, expiry dates, product exclusions or usage limits. Unless expressly stated otherwise, discounts cannot be exchanged for cash and may not be combined with other offers.

14. Intellectual property

Unless otherwise stated, the website content, Big Bee branding, text, graphics, images, layout and other materials are owned by or licensed to us and are protected by applicable intellectual property laws.

You may use the website for ordinary personal or business purchasing purposes. You must not reproduce, distribute, republish or commercially exploit our website content without permission, except where permitted by law.

Third-party trade marks, logos and product names remain the property of their respective owners.

15. Third-party services and links

Our website may use or link to third-party services, including payment providers, delivery carriers, social platforms and other websites. We are not responsible for the content or practices of third-party websites that we do not control. Your use of third-party services may also be subject to their own terms and privacy policies.

16. Website availability and changes

We may update, suspend, change or discontinue parts of the website from time to time. We do not guarantee that the website will always be available without interruption or error.

17. Liability and non-excludable rights

To the maximum extent permitted by law, we are not responsible for losses caused solely by events outside our reasonable control, failure by an international customer to check destination-country import or workplace requirements, or use of a product in a way that is contrary to its instructions, stated specifications or known workplace requirements.

However, nothing in these Terms excludes, restricts or modifies any liability, consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified under the Australian Consumer Law or other applicable mandatory law.

18. Governing law and jurisdiction

These Terms and contracts formed with Big Bee are governed by the laws of New South Wales, Australia, to the maximum extent permitted by applicable law.

Subject to any mandatory law or jurisdiction right that cannot lawfully be excluded, the parties submit to the courts of New South Wales, Australia and courts entitled to hear appeals from those courts.

A choice of Australian law does not exclude any mandatory consumer protection that applies to a customer and cannot lawfully be excluded by agreement.

19. Changes to these Terms

We may update these Terms from time to time. The current version will be published on our website with the updated date.

The Terms that apply to an order are generally those published when the order was placed, together with any specific terms agreed for that order.
